{"id":57,"date":"2010-07-26T17:49:20","date_gmt":"2010-07-26T17:49:20","guid":{"rendered":"http:\/\/www.taxdebtadvisors.com\/blog\/?p=57"},"modified":"2022-06-21T17:01:21","modified_gmt":"2022-06-21T17:01:21","slug":"collection-statute-expiration-date","status":"publish","type":"post","link":"https:\/\/taxdebtadvisors.com\/blog\/collection-statute-expiration-date\/","title":{"rendered":"COLLECTION STATUTE EXPIRATION DATE"},"content":{"rendered":"<h2>Collection Statute Expiration Date &#8211; CSED<\/h2>\n<p>If the IRS does not collect the taxes within ten years form the date of assessment, then the tax is abated and liens are released against the taxpayer\u2019s property.\u00a0 If you have several years that you owe on, it is advisable to designate your payments when possible to the most current years rather than to older years that may be close to expiring.\u00a0 The IRS, without designation from the taxpayer will always apply payments to the oldest debt.\u00a0 In most cases the IRS will apply voluntary payments to the oldest tax debt regardless of any designation made by the taxpayer.<\/p>\n<p>There are some actions by the taxpayer that can extend the <a href=\"https:\/\/www.taxpayeradvocate.irs.gov\/tax-terms\/collection-statute-expiration-date-csed\/\">CSED<\/a>.\u00a0 The most common are a pending bankruptcy, a judgment or litigation in tax court, a collection due process appeal, a pending offer in compromise or when the taxpayer voluntarily signs a waiver extending the collection statute.<\/p>\n<p>If you think your tax debts have expired we can confirm this verbally and in writing from the IRS.\u00a0 This inquiry if done correctly does not need to wake up a \u201csleeping giant.\u201d\u00a0\u00a0 Most taxpayer are under the false assumption that once you owe the IRS the debt will stay there until fully paid.\u00a0 State laws differ from the IRS.\u00a0 Some states have no expiration dates on tax debts.\u00a0 If you are uncertain as to your tax debt status, especially those that might have expired, we can help you get a confirmation and clear up tax liens that will likely still be marks against your credit.<\/p>\n<p>Scott Allen E.
