IRS penalty abatement by Mesa Arizona’s Tax Debt Advisors

Tax Debt Advisors, Inc.—IRS Penalty Abatement

It is not uncommon to have the IRS interest and penalties exceed the amount of the tax by two or three times.  When it comes specifically to IRS penalty abatement in Mesa AZ there are two easy ways to abate penalties and one hard way.

The easiest way is to amend a return if you in fact have deductions that were not included in the original return.  IRS Penalties will come down with the accepted amendment in proportion to the reduction in tax.

The second easy way for IRS penalty abatement in Mesa AZ s is to file a correct return in place of an IRS substitute for return.  The method the IRS uses to calculate taxes owed is to the greatest advantage possible against the taxpayer.  When a correct return is filed, not only does the tax go down but also the penalties.

The hardest of the three is to file IRS Form 843 and request an abatement of penalties.  You have to have a good reason and it helps to have a good track record of filing and paying on time in the past.

Acceptable reasons for IRS penalty abatement in Mesa, AZ

Tax Debt Advisors, Inc—Acceptable reasons for Mesa, AZ IRS penalty abatement
If you were hospitalized or had a serious hardship that prevented you from filing or full paying your taxes on time, your request will be considered.  There are numerous reasons that qualify as a serious hardship, but the key is how it prevented you from filing or paying.  There are millions of taxpayers affected by the same hurricane that handled their taxes appropriately.  So the burden of proof is why the hurricane made it impossible or at least created a hardship different from the others that complied with the law.

If you have multiple years that you feel should qualify for penalty abatement, you need to file IRS Form 843 for each year.  You may find that the IRS agrees to penalty abatement in Mesa AZ for the first year and deny penalty abatement for later years.  And the IRS may feel having a problem for one year makes sense but allowing penalty abatement for the same reasons for multiple years could be unfair who taxpayers to complied with the law.

Scott Allen E.A. of Tax Debt Advisors has the experience to advise and request your Mesa AZ IRS penalty abatement.  If you are seeing a free initial consultation contact Scott Allen E.A. at 480-926-9300

Abate IRS tax penalties in Mesa Arizona

Tax Debt Advisors, Inc. can help you with your IRS Abatement of Penalties in Mesa AZ

One of the worst IRS penalties is the failure to file penalty.  This penalty is 5% per month for the first 5 months that you file late.  So by not filing an extension you have added 25% to your total tax debt if you owe on your return.  The IRS will consider Mesa AZ abatement of penalties if you can show “reasonable cause.”  This would have to include serious illness including depression, weather disaster, or some economic hardship that caused you to file late.

The failure to pay penalty is ½% per month.  This penalty is 1/10th of the failure to file penalty.  So the IRS thinks it is ten times worse that you don’t file than not paying your taxes.  On both of these penalties, it is best to have paid off the tax debt owed before requesting abatement of these two penalties.  Request your Mesa AZ penalty abatement by submitting IRS Form 843.  You should expect the IRS to request proof of your reasons for not paying or filing on time.

In either situation, consider a free initial consultation with Scott Allen E.A. at Tax Debt Advisors, Inc. in Mesa Arizona.  You can contact Scott at 480-926-9300.

Mesa AZ IRS offer in compromise forms

The two most common Mesa AZ IRS Offer in Compromise (OIC) forms are the 433-A for individuals and 433-B for businesses.  There is also a $150 non-refundable application fee and a non-refundable initial payment.  You will also have to decide on a payment option.  There are two payment options:

Lump Sum Cash: Initial payment must be 20% of the total OIC amount.  After acceptance the remaining balance must be paid in five or fewer payments.

Periodic Payment: Initial payment must be 20% of the total OIC amount and continue to pay the remaining balance in monthly installments while the IRS considers your offer.  If your OIC is accepted, monthly payments need to be maintained until the agreed amount is paid in full.

If you meet the Low Income Certification guidelines, you are not required to send in the $150 application fee or the initial 20% payment or monthly installments during the evaluation period.
