We are Mesa Arizona’s Top IRS Problem Solvers for Successful IRS Solutions, Part 10

Some of the best advice concerning how to conduction business as well as how to successfully release Mesa AZ IRS levy comes from Confucius.  Consider the follow sage advice:
  • When anger rises, think of the consequences.
  • To see what is right, and not to do it, is want of courage or of principle.
  • I hear and I forget.  I see and I remember.  I do and I understand.
  • Our greatest glory is not in falling, but in getting up every time we do.
  • When you have faults, do not fear to abandon them.
  • The superior man acts before he speaks, and afterwards speaks according to his actions.
  • The cautious seldom err.
  • The superior man is satisfied and composed; the mean man is always full of distress.
  • By nature, men a nearly alike; by practice, they get to be wide apart.
  • Respect yourself and others will respect you.
  • A man, who has committed a mistake and doesn’t correct it, is committing another mistake.
  • By three methods we may learn wisdom: First, by reflection, which is noblest; second, by imitation, which is easiest; and third by experience, which is the bitterest.
  • He who learns but does not think, is lost!  He who thinks but does not learn is in great danger.

We are Mesa Arizona’s Top IRS Problem Solvers for Successful IRS Solutions, Part 9

Here is a quote from Lao-Tzu that has taught us how conduct our family owned IRS problem business in Mesa AZ for over 37 years.  There is great wisdom in the following words:

Act without doing: work without effort.  Think of the small as large and the few as many.  Confront the difficult while it is still easy; accomplish the great by a series of small acts.  The Master never reaches for the great; thus he achieves greatness.  When he runs into difficulty, he stops and gives himself to it.  He doesn’t cling to his own comfort; thus problems are no problem for him.

Abate IRS tax penalties in Mesa Arizona

Tax Debt Advisors, Inc. can help you with your IRS Abatement of Penalties in Mesa AZ

One of the worst IRS penalties is the failure to file penalty.  This penalty is 5% per month for the first 5 months that you file late.  So by not filing an extension you have added 25% to your total tax debt if you owe on your return.  The IRS will consider Mesa AZ abatement of penalties if you can show “reasonable cause.”  This would have to include serious illness including depression, weather disaster, or some economic hardship that caused you to file late.

The failure to pay penalty is ½% per month.  This penalty is 1/10th of the failure to file penalty.  So the IRS thinks it is ten times worse that you don’t file than not paying your taxes.  On both of these penalties, it is best to have paid off the tax debt owed before requesting abatement of these two penalties.  Request your Mesa AZ penalty abatement by submitting IRS Form 843.  You should expect the IRS to request proof of your reasons for not paying or filing on time.

In either situation, consider a free initial consultation with Scott Allen E.A. at Tax Debt Advisors, Inc. in Mesa Arizona.  You can contact Scott at 480-926-9300.

Making sure you qualify for a Mesa AZ IRS Offer in Compromise

Tax Debt Advisors will make sure you qualify for a Mesa AZ IRS Offer in Compromise before submitting it

To be eligible to file a Mesa AZ IRS Offer in Compromise (OIC) you must have filed all past tax returns or at least have assessments from substitute for returns.  The current year return must be filed and full paid.  If you are currently in a bankruptcy the IRS will reject your Offer in Compromise application.  The IRS has an Offer in Compromise booklet, IRS form 656-B, and a video to help taxpayers who want to file a Mesa IRS Offer in Compromise.  This may make it seem that submitting an OIC is an easy process.  It is.  What is hard is submitting all the information in the format the IRS will seriously consider.  Most taxpayers are unable to submit all the Mesa AZ IRS Offer in Compromise forms and calculate the correct OIC amount.  The IRS Offer in Compromise reviewers are looking for any information that is incomplete.  The easiest way to achieve a successful OIC is to locate an IRS professional who can assist you along the way.

Scott Allen E.A. of Tax Debt Advisors has the experience to stay on top of the process from beginning to end.  The IRS Offer in Compromise group has a terrible history of losing, mishandling or reassigning your OIC and it falls “between the cracks.”  The OIC group needs a follow call on a regular basis depending on the facts and circumstances and the agent working the OIC.  This only comes from experience.  Tax Debt Advisors has been representing Mesa AZ clients since 1977.  Call today at 480-926-9300 for a free consultation.

Mesa AZ IRS offer in compromise forms

The two most common Mesa AZ IRS Offer in Compromise (OIC) forms are the 433-A for individuals and 433-B for businesses.  There is also a $150 non-refundable application fee and a non-refundable initial payment.  You will also have to decide on a payment option.  There are two payment options:

Lump Sum Cash: Initial payment must be 20% of the total OIC amount.  After acceptance the remaining balance must be paid in five or fewer payments.

Periodic Payment: Initial payment must be 20% of the total OIC amount and continue to pay the remaining balance in monthly installments while the IRS considers your offer.  If your OIC is accepted, monthly payments need to be maintained until the agreed amount is paid in full.

If you meet the Low Income Certification guidelines, you are not required to send in the $150 application fee or the initial 20% payment or monthly installments during the evaluation period.

Scott Allen E.A. of Tax Debt Advisors, Inc. has the experience to guide you through the Mesa AZ IRS offer in compromise process from beginning to end.  Tax Debt Advisors offers a free initial offer in compromise Mesa AZ review and can be reached at 480-926-9300 to schedule an appointment.

How to verify and possibly lower your Mesa Arizona IRS debt

How do you verify and possibly lower your IRS tax debt in Mesa AZ?

If you know you have been behind in filing and/or paying taxes and need to get an X-ray on your Mesa AZ IRS tax debt here is a checklist to follow:

  • An IRS record of account is the IRS book for each year they claim you owe back taxes.  It records all payments as well as any interest or penalties accruing on the balance due.
  • Consult with a tax advisor on any discrepancies you may feel need to be checked.  Your advisor may have good advice on how to apply future payments which you have some discretion over.
  • If a balance due is from an IRS “prepared” return called a substitute for return, you very likely can file a correct return and lower the balance due.
  • If you feel a return that you filed was done incorrectly, resulting in a higher tax liability than it should, contact Scott Allen E.A. of Tax Debt Advisors for a free consultation to see if amending your tax return in Mesa AZ will save you money.
  • On occasion there are good reasons to request an abatement of Mesa AZ IRS penalties.  Scott Allen E.A. has the expertise to request abatement of penalties using IRS Form 843.
  • Consider having a consultation with Scott Allen E.A. of Tax Debt Advisors if you are in trouble with the IRS or need current year tax preparation in Mesa AZ.  Scott can be reach at 480-926-9300.

IRS Form 8857, Mesa AZ Taxpayer’s Request for Innocent Spouse Relief

You must submit IRS Form 8857 if you are:
  • Seeking Innocent Spouse Relief
  • Separation of Liability Relief
  • Equitable Relief.
Besides filling out the information requested you must include a written statement which is signed under penalties of perjury.  IRS Publication 971 provides complete information regarding all three relief options.  The IRS web site at www.IRS.gov website has information found under Tax Information for Innocent Spouses on this subject.

If you live in a community property state and filed as married filing separate rather than married filing joint, you might still qualify for innocent spouse relief.  Community property states are Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin.

Relief from joint and several liability should not be confused with an injured spouse claim.  You are a Mesa Arizona “injured spouse” if you file a joint return and all or part of your share of the refund was, or will be, applied against the separate past-due Federal Tax, state tax, child support, or Federal non-tax debt such as a student loan of your spouse with who you filed the joint return.  This tax remedy requires the filing of IRS Form 8379. Scott Allen E.A. of Tax Debt Advisors, Inc. has the expertise to assist you on your request for innocent spouse relief in or injured spouse relief in Mesa AZ. Schedule an appointment by calling Scott at 480-926-9300.

Mesa AZ abatement of IRS penalties from Tax Debt Advisors, Inc

The request process is two tiered. The first is to file your Mesa AZ abatement of IRS penalties request with IRS Form 843. This form asks for details about you and the tax years in question. The reason for the abatement can be a part of the form or a separate letter attached to the form. Prior to sending in IRS Form 843, you should pay the amount of tax you owe or at least have a payment plan in place. The form gives the address where to mail it to the IRS. Submitting your Mesa AZ abatement of IRS penalty request without having a good reason is like rubbing a lamp in your house—there will be no genie with the IRS. You cannot use the excuse that you want Mesa AZ abatement of IRS penalties because you didn’t know or understand the tax law. The IRS considers it your responsibility to know the law or use someone who does. The second process is to take your request to the IRS Office of Appeals. The reason still needs to be valid but you might have a more compromising attitude with an Appeals officer.
Scott Allen E.A. of Tax Debt Advisors, Inc. knows the tax laws and will be able to competently advise you on your reasons for requesting an abatement of IRS penalties in Mesa AZ and the chances for success. Tax Debt Advisors, Inc. offers a free initial consultation and can be reached at 480-926-9300 for an appointment.
