  • Auditors will consider all deposits to your bank account as income.  Keep records of gifts from parents, refunds on returned merchandise and other similar transactions to show the auditor why that item was not income.
  • The most common audit adjustment comes from mileage claimed on the return.  If I ever have a client who is audited on mileage that actually has a mileage log that they kept concurrently, will then be able to say, “I have seen everything, now!”  Taking actual expenses may be the best way to go if you want to be able to substantial your automobile expenses.
  • Personal use items.  This would be like claiming you use your vehicle 98% for business purposes.  That means that you almost never shop for food, take a vacation, go to church, visit friends, or go to the movies.  Unless you are Howard Hughes, make your % something reasonable.  Believe it or not almost all of my clients who have one car, when I ask them what percent they used the vehicle in the business, the first time, will say “100%.”  This extends to home office expense as well.  One client tried to convince me he lived in his back yard so he could deduct all of his housing expenses on his schedule C.  If you have one phone and it is a cell phone, allocate a reasonable amount for personal use.

Errors of the kind mentioned will almost always lead to other years being audited.  If have been really out of line you might even get yourself  put on the IRS Auditors bulletin board that has this heading—If You Need An Audit To Impress Your Manger Call (your name and phone number)—just kidding, but sometimes it feels that way.

Can the IRS put a lien on my house when I am making monthly payments on what I owe?

The answer is yes.  Any time you owe the IRS, they can put a lien on your house and other property that you own.  You should expect a lien to be filed even if you are on a monthly installment arrangement or a non-collectible status.  Even if you are in the process of applying for an offer in compromise the IRS can file a tax lien if they are concerned about the amount being offered.

If you feel that there is a legitimate reason why the IRS should not have filed a tax lien, you have the option of filing a collection due process appeal.  In most cases, you will not be successful in removing the lien unless it is due to an error on the part of the IRS, or when a return is assessed it will prove that you will not own any taxes.  If you desire to get a tax lien removed in order to get a loan to pay the balance owed off in full, the IRS will subordinate the lien in order to allow a bank to make the loan.

Will the IRS be willing to accept a low offer in compromise if they know I can discharge the taxes in a bankruptcy?

Arizona IRS Offer in Compromise

I have seen where the ability to file a bankruptcy has had a positive effect on getting an Arizona IRS offer in compromise accepted if there are genuine areas of disagreement on how assets should be valued in determining the offer amount.  I have also seen situations where the IRS will not budge on an offer amount even if you decide to file a bankruptcy.  There is a lot of variation in the way the offer in compromise group handle offers when the option to discharge the taxes in a bankruptcy is available.  If the tax debt is on a current year, the IRS knows that you must wait three years from the due date of the return before you can file a bankruptcy.  In that case, the option of filing a bankruptcy would not be taken into consideration.  Each situation has to be evaluated on its own merits.  Working with a professional who has seen lots of Arizona IRS offer in compromise’s accepted when a bankruptcy is an option is the only way to get an objective opinion.

IRS much more aggressive on filing Tax Liens

The IRS has aggressively increased the number of liens issue in 2009 over 1999—475% more.  Even Nina Olson, the national tax payer advocate concedes that it is causing unnecessary harm to some taxpayers and even reducing the amount the IRS is able to collect.  Olson told CNNMoney, “Taxpayers are being greatly harmed for very little benefit to the government.”  Nina says that tax lien issuance is one of the top five problems that Congress must deal with to help taxpayers.

When you are under threat of a tax lien being filed, it is important to consider arguing, with professional help, the disadvantages a tax lien will cause to delay the payment of delinquent taxes.  The IRS allows taxpayers an opportunity to argue their case before the Office of Appeals.  Serious consideration of filing an appeal should be made so that you are not limited in your ability to pay off your tax debt due to a tax lien.

ARIZONA IRS PROBLEMS – How long will ACS give me to file back tax returns?

There is no hard and fast rule you can rely on here.  Generally, ACS will limit you to 30 days.  However, it you have broken past commitments, they may and can expect the returns to be filed in as little as 3 days.  If several years of tax returns need to be filed and ACS has given you 30 days to file all of them, usually they will give you an extension of time to file the remaining ones if you contact them before the deadline, have filed most of them, and have a reasonable reason for needing more time.  As an example; if a client has to file 6 returns and has filed 4 of them within the deadline period, ACS will usually allowed additional time.  Unfortunately, this can depend on who you get at the other line.  I can usually tell before making a request for additional time if the person at ACS will agree to this or not.  If I know that they are unlikely to respond favorably, I will simply hang up and call back until I have the right person. Can the IRS file a lien on a home in Gilbert Arizona I own jointly with a friend?

Yes, as long as your name is on the title the IRS can and will file a tax lien on a home in Gilbert Arizona for the full amount of the taxes you owe.  The only time this will become a problem is if you decide to sell the house before the amount of taxes owed are paid.  The IRS is not interested to taking what is rightfully owned by someone else and unless the IRS is notified of the situation ahead of the sale, any amount left over after the mortgage is paid will go to the IRS.
