IRS Tax Debt and Confidentiality

Do IRS Tax Attorneys in Gilbert Arizona Provide a Higher Level of Confidentiality?

All IRS resolution experts are required to keep confidential any information disclosed to them whether they be a Gilbert AZ IRS Tax Attorney, Enrolled Agent (E.A.) or CPA?  The only time this becomes critical is in the matter of criminal cases.  An IRS Tax Attorney in Gilbert, AZ has “attorney client privilege.”  This means that if you have committed a criminal act, the IRS Tax Gilbert Attorney is allowed to keep information confidential.

The problem comes when less than 1 out of 10,000 clients that we have seen over the last 45 years has committed a criminal act and should retain the services of a Gilbert, AZ IRS Tax Attorney.  Yet when our clients have talked to a Gilbert Tax Attorney, the attorney always mentions that they have attorney client privilege as if that is needed in your case—which is almost never.  So why pay two or three times as much for something you don’t need.

If you scheduled a free consultation with Scott Allen E.A. at 480-926-9300 he can tell you if you have committed a criminal act and need the services of an IRS Tax Attorney in Gilbert, AZ.  If that is the case, he will be able to refer you to a Tax IRS Attorney Gilbert, AZ that specializes in the tax representation area you require.

What is an SFR return and the purpose of the SFR Unit?

IRS SFR Return help near Gilbert Arizona

SFR stands for substitute for return.  When a tax return has not been file for an extended period of time, the IRS will eventually file a substitute return that calculates the tax based on income reported with no deductions.  If a person was filing jointly before, the IRS will file the SFR return as married filing separate.  The purpose of the SFR unit is to prepare the substitute return and process any returns that are later filed as a “protest” against the SFR return by the taxpayer.  When filing a return in response to an SFR, it is best to send it to the SFR unit that is responsible for making any adjustments to the SFR amount owed.  The turn around time to get a tax balance lowered after filing a correct return can take several months.  SFR returns are not dischargeable in a bankruptcy since they are not considered filed returns.  However the SFR does have the same 10 statute of limitations for collection as a return filed by a taxpayer.

Before making any decisions on how to handle an IRS SFR return near Gilbert Arizona it is critical to first discuss your situation with a tax professional.

IRS Form 2848

Internal Revenue Service Form 2848

This IRS form is used to give permission for someone else to represent you before the IRS.  It is referred to as an IRS Power of Attorney.  It is limited to the items described on the form and those areas of representation are limited to IRS matters.  Typically the form will state what type of tax—individual income tax, form number—1040, and tax years covered—2002-2022.  If there is a problem with any years outside of those mentioned, the IRS will not allow your representative to work on those years.  If you have a payroll tax problem in addition to an individual income tax problem, it too must be separately mentioned.  Before we begin any work on resolving a tax problem, we require a power of attorney.  A power of attorney allows us to get information needed to resolve successfully your current IRS problem.  It is time to stop IRS action against you and hire Scott Allen EA to be your IRS power of attorney. He will put your mind at ease.
