Phoenix IRS Offer in Compromise

If you have the opportunity to file a tax court petition or a Phoenix IRS offer in compromise—always file the tax court petition.  An offer will take a long time to process and it is doubtful that you will know the amount of the offer that will ultimately be acceptable to the IRS.  The filing period for a tax court petition is only 90 days.  You will not know the results of an offer before the deadline on the tax court petition will lapse.  If you are working with a competent representative you should know what you will be expected to pay on your tax court petition.  Also, you should never or almost never expect to go to tax court.  Your advisor should get your case assigned locally to the Appeals Office at the IRS.  This is one area that you should most definitely consult with a representative to know your options under both situations before getting started.

There are several different ways to get an IRS Settlement Queen Creek Arizona ?  I am always uncomfortable quoting or giving averages when it comes to settling up with the IRS.  Here is why.  If you are talking about a settlement with an Offer in Compromise, over 98% of the clients who come in don’t qualify for this type of a settlement for various reasons.  So what good is an average when you are only talking about 2%.  We have had some offers for as low as ½ cent on the dollar up to 88 cents on the dollar.  If those were the only two offers, saying the average is 44 cents on the dollar is a ridiculous statement.  For one it would be 8,800% too high and the other 50% too low.  I suppose an average of 15% might be reasonable on all of the Offer in Compromises we have had accepted for clients.

If a client discharges their taxes under the Chapter 7 rules of bankruptcy then the settlement is zero.  It is always zero.  How do you give an average here other than to say our average settlement is zero if you choose to settle your IRS debt using a Chapter 7 bankruptcy?  There is no average, it is always the same.

GET IRS OFF MY BACK – How long after I get a notice from the IRS will they take action?

Can I get the IRS off my back?

It depends upon the type of letter you get.  Generally, most letters from the IRS give you 30 days to take some corrective action before the IRS will lower the boom.  Many letters mention 10 days.  This usually means you have 10 days to pay the amount due or additional interest or penalties will be added to the balance.  Clients read the words 10 days and stop there.  If they read further they would read that they have 30 days in most cases to take action.  But even though the IRS can take action in 30 days, it may be much longer before they actually do.  However, it is a poor bet to take any chances.  If you are uncertain as to what should be your next step, seek the advice of an IRS resolution specialist.  Call Scott Allen EA of Mesa Arizona at 480-926-9300.

How to choose an IRS representative in Mesa AZ?

First, and perhaps the most important consideration is to make sure that the person who will represent you is the person setting in front of you in your initial interview.  If you are only meeting with a sales person who will send your fee and paperwork to another location, you will be disappointed.  So find someone local who can be held to a higher level of performance than someone outside your local area.

Second, if you hear the phrases, “pennies on the dollar” or “wipe out all your penalties and interest” you will be disappointed 98% of the time.  Those solutions exist but are relatively rare occurrences.

Third, if you are told something that you want to believe but it sounds too good to be true, it probably is.  Get a second opinion.

Six, make sure you have all of your options before you at one time before picking the best solution for you.  Every settlement option has something good about it and something not so good about it.  However, one is much better than the others.  Some IRS settlements require more than one option and it is important that you understand when you are to switch from one option to another.

Collection Statute Expiration Date – CSED

If the IRS does not collect the taxes within ten years form the date of assessment, then the tax is abated and liens are released against the taxpayer’s property.  If you have several years that you owe on, it is advisable to designate your payments when possible to the most current years rather than to older years that may be close to expiring.  The IRS, without designation from the taxpayer will always apply payments to the oldest debt.  In most cases the IRS will apply voluntary payments to the oldest tax debt regardless of any designation made by the taxpayer.

There are some actions by the taxpayer that can extend the CSED.  The most common are a pending bankruptcy, a judgment or litigation in tax court, a collection due process appeal, a pending offer in compromise or when the taxpayer voluntarily signs a waiver extending the collection statute.

If you think your tax debts have expired we can confirm this verbally and in writing from the IRS.  This inquiry if done correctly does not need to wake up a “sleeping giant.”   Most taxpayer are under the false assumption that once you owe the IRS the debt will stay there until fully paid.  State laws differ from the IRS.  Some states have no expiration dates on tax debts.  If you are uncertain as to your tax debt status, especially those that might have expired, we can help you get a confirmation and clear up tax liens that will likely still be marks against your credit.
