IRS innocent spouse relief for Mesa AZ taxpayers

A question you might be asking yourself:  Do I need a Mesa AZ tax attorney for my IRS innocent spouse relief?

First thing to note is that filing for innocent spouse relief does not require the need to hire a tax attorney in Mesa AZ.  You can file for innocent spouse relief on your own, with a CPA or an Enrolled Agent.  If do you hire some to represent you it is important that you meet with that person face-to-face.  I highly discourage working with an out of state company.  My I suggest to you Scott Allen EA in Mesa AZ.  He promises a quick response and follow through service.  Below is a list of things to consider before applying for Mesa AZ innocent spouse relief.

  1. You CANNOT have benefited from unreported income or incorrect deductions on a jointly filed tax return.
  2. In a community property state (Arizona is) you may file a married filing separate return as long as both parties involved report their share of income correctly.
  3. You have to be able to prove you innocence in the issue and that you did not know what you spouse was doing or preparing.

If very important to note that the IRS will do their own investigation in the process.  That process can take 6-12 months.  They will attempt to contact your spouse to get his or her side of the story.  You want to avoid making false claims that will only make the matter worse and the debt larger.  Upon innocent spouse relief being accepted the entire share of tax, interest, and penalties will be removed from your account.

Scott Allen EA of Tax Debt Advisors has the experience in preparing and filing innocent spouse claims if he determines you are a candidate.  Consider calling him today before calling a Mesa AZ tax attorney for your IRS matter.  Schedule a free consultation in his office.  Click here for more information.

IRS problem work in Mesa Arizona

IRS problem work in Mesa AZ at its best.  Click here for more info.

Last week I got a call from a potential new client here in the Phoenix AZ area.  His question to me was: “I have my refund check from 1984 for $1500 and I need to get in contact with the IRS to cash it.  Where do I go to get that done? Can you help me?”

I didn’t know how to answer the question at first.  I thought maybe he meant to say 2014 or 2004 IRS refund check.  The IRS has a statute of limitations on refunds and payments made to the IRS.  They have at least since I started doing tax return work here in Mesa Arizona.  Refunds are only good from 3 years past the due date of the tax return.  If a tax extension was filed then the 3 year rules would start from that due date.  There isn’t must that can be protested or challenged on this rule unless you can determine or prove that the IRS did something wrong on their end.  Lets say you make a payment to the IRS but do not get around to filing the tax return 5 years later.  That payment will offset any tax liability owed but if a refund is due you will not see the net difference as that payment is held to a 2 year statute on that.  The best advice I can give my new and current IRS problem and tax preparation clients in Mesa AZ is to always file by the deadlines even if you do not have the money to pay the taxes.  90% of the penalties come from not filing; not from not paying.  Payment arrangements and other options are available to pay back the tax debt owed.  To see the different settlement option below please visit my website at www.taxdebtadvisors.com.  My office is here in Mesa AZ and we are a local family company that files back taxes and settle IRS debts.  Call Scott Allen EA today at 480-926-9300 for a free consultation.

What if I cannot pay off my Mesa AZ IRS debts?

What options do I have? – Contact Scott Allen EA in Mesa AZ now.

Many times when I meet with new clients they come in only to find out there are not in the best possible settlement with the IRS.  They either negotiated it on their own or hired other professional help.  Before I begin the negotiation process with my clients I first get an IRS Power of Attorney signed authorizing me to represent them before the IRS.  The most important thing I do for my clients in that step is evaluating all available settlement options with them so they don’t have any “buyer remorse” on what has been established for them.  If together we determine that a payment plan is the best possible solution for your Mesa, AZ IRS debt we promise to get you the lowest monthly payment allowed by law.  If we determine you qualify for an Offer in Compromise we guarantee it to be processed accurately for the IRS.  If we determine you are in a financial hardship we can get the IRS to put you in a currently non collectible status on all of your IRS tax debts.  Many clients are not aware that most Mesa AZ IRS tax debts can be discharged in a chapter 7 or chapter 13 bankruptcy.  We can contact the IRS for you and determine if your taxes qualify for a tax bankruptcy and when.  If it was possible everyone would want the quick fix to end their IRS nightmare.  That is not always the case.  It might take you to go thru a couple of steps before your IRS debt get resolved.  If you give me, Scott Allen EA a call I offer a free consultation to evaluate your situation.  We can file all back tax returns (if applicable) that need to be filed.  I can be reached at 480-926-9300 or visit my contact page

IRS penalty abatement by Mesa Arizona’s Tax Debt Advisors

Tax Debt Advisors, Inc.—IRS Penalty Abatement

It is not uncommon to have the IRS interest and penalties exceed the amount of the tax by two or three times.  When it comes specifically to IRS penalty abatement in Mesa AZ there are two easy ways to abate penalties and one hard way.

The easiest way is to amend a return if you in fact have deductions that were not included in the original return.  IRS Penalties will come down with the accepted amendment in proportion to the reduction in tax.

The second easy way for IRS penalty abatement in Mesa AZ s is to file a correct return in place of an IRS substitute for return.  The method the IRS uses to calculate taxes owed is to the greatest advantage possible against the taxpayer.  When a correct return is filed, not only does the tax go down but also the penalties.

The hardest of the three is to file IRS Form 843 and request an abatement of penalties.  You have to have a good reason and it helps to have a good track record of filing and paying on time in the past.

Acceptable reasons for IRS penalty abatement in Mesa, AZ

Tax Debt Advisors, Inc—Acceptable reasons for Mesa, AZ IRS penalty abatement
If you were hospitalized or had a serious hardship that prevented you from filing or full paying your taxes on time, your request will be considered.  There are numerous reasons that qualify as a serious hardship, but the key is how it prevented you from filing or paying.  There are millions of taxpayers affected by the same hurricane that handled their taxes appropriately.  So the burden of proof is why the hurricane made it impossible or at least created a hardship different from the others that complied with the law.

If you have multiple years that you feel should qualify for penalty abatement, you need to file IRS Form 843 for each year.  You may find that the IRS agrees to penalty abatement in Mesa AZ for the first year and deny penalty abatement for later years.  And the IRS may feel having a problem for one year makes sense but allowing penalty abatement for the same reasons for multiple years could be unfair who taxpayers to complied with the law.

Scott Allen E.A. of Tax Debt Advisors has the experience to advise and request your Mesa AZ IRS penalty abatement.  If you are seeing a free initial consultation contact Scott Allen E.A. at 480-926-9300

Quotes on Success

During the last 50 years or so the surest way to success financially has been to write a book on what to do to be successful.  What was lacking is a proper definition of what success is.  Success is a little bit like beauty.  Success “is in the eye of the beholder.”  However knowing what has been discovered and analyzed by many people can give us a starting point to refine our definition and chart our course for our goals for success.  As you read these quotes you may find yourself saying, “that one is just like some of the others.”  So why did I include something similar from two or more quotes from different people?  Because, that’s a pretty good indication of something being universally right or accepted.  Those items are the diamonds among the other lesser gems.
